Terms of Service for TrackedSnap

        Please Read Carefully: By downloading, installing, or using TrackedSnap, you agree to these Terms of Service. If you do not agree, please do not use the app.
    

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the TrackedSnap mobile application ("App") developed by Willis Worxs, LLC ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

TrackedSnap is a photo tracking application designed to help users document construction projects, renovations, and other progress-based work through GPS-tagged, orientation-aligned photography. The App provides:

Camera functionality with overlay alignment guides
GPS location tagging for photos
Project and view organization
Photo comparison and merging features
Local data storage on your device
Optional TrackedSnap Pro features via in-app subscription

3. User Accounts and Eligibility

No account creation is required to use TrackedSnap. All data is stored locally on your device.

You must be at least 13 years old to use this App. By using the App, you represent that you meet this age requirement.

4. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use TrackedSnap for personal or commercial use, subject to these Terms. This license does not include:

Resale or commercial distribution of the App itself
Modification, reverse-engineering, or decompilation of the App
Removal of copyright or proprietary notices
Use of the App for illegal purposes

5. User Responsibilities

You are responsible for:

Data Backup: Backing up your photos and project data. We are not responsible for data loss.
Device Security: Protecting your device with a passcode or biometric authentication.
Lawful Use: Using the App in compliance with all applicable laws and regulations.
Privacy Rights: Not using the App to photograph people or property without proper consent or authorization.
Storage Management: Managing your device storage. Photos can consume significant space.

6. TrackedSnap Pro and Subscriptions

6.1 Free Features

The free version of TrackedSnap has no photo limit and includes:

Every capture guide: reference overlay, Auto Capture, level, compass and GPS guides, and the format guide
Projects, views, the map and reminders
Saving original photos to your Photos library

6.2 TrackedSnap Pro Subscription

TrackedSnap Pro is an auto-renewing subscription, billed monthly or yearly. Pro adds before-and-after reveals and video export, your logo and brand colors on videos, organized folders in your Photos library, and iCloud Backup to your own iCloud Drive.

Pricing: The current monthly and yearly prices are displayed in the app and confirmed by Apple before purchase.
Free Trial: Any eligible introductory offer is displayed by the App Store before you confirm your subscription.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Changing Plans: You can switch between monthly and yearly billing in your Apple Account subscription settings
Cancellation: Cancel anytime through App Store account settings
Refunds: Managed by Apple; we cannot issue refunds directly

6.3 Payment Processing

All payments are processed by Apple through the App Store. Apple's Terms of Service and Privacy Policy apply to all transactions.

6.4 Creator Codes

Before your first subscription starts, you can enter a creator code in Settings or on the paywall under Support a Creator. The first accepted code stays linked to your subscription and its renewals. A code does not change your price. The creator earns a share of your payments from us under a separate agreement. We may pause or remove any code.

6.5 Earn a Free Month

You can submit a finished before-and-after video made in TrackedSnap for review. Submissions are optional.

Limit: One submission per calendar month (UTC). Videos can be up to 50 MB.
Review: We review every submission and decide whether to approve it. Low-quality, repetitive or previously rewarded videos may not qualify, and approval in one month does not guarantee approval in future months. A declined video earns no reward.
Reward: An approved video adds one calendar month of TrackedSnap Pro after your current Pro access ends, or from approval if you have none. A reward has no cash value and cannot be transferred.
Billing: A reward does not cancel, pause or refund an App Store subscription. Existing Apple subscriptions keep renewing until you cancel them in your Apple Account settings.
Your Permission: By submitting, you confirm that you own the video and have permission from anyone shown in it. You allow TrackedSnap to edit and repost the video on its social media accounts to promote the app.
Private Details: Do not submit videos that show patient information, faces of people who have not agreed, addresses, or other private details.

Contact support@trackedsnap.com with questions about a submission or to ask that a video not be used in the future.

7. Intellectual Property

All content, features, and functionality of TrackedSnap are owned by Willis Worxs, LLC and are protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain all rights to the photos you capture using the App. We claim no ownership or rights to your photos.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the App will be uninterrupted, error-free, or secure
Warranties regarding the accuracy, reliability, or quality of any content or data

We do not guarantee that:

The App will meet your specific requirements
GPS location data will be 100% accurate
Your data will never be lost (always maintain backups)
The App will be compatible with future iOS versions without updates

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Loss of photos, data, or projects due to device failure, app bugs, or other causes
Inaccurate GPS coordinates or orientation data
Damages resulting from your reliance on the App for critical documentation
Indirect, incidental, special, consequential, or punitive damages
Lost profits, revenue, or business opportunities

Maximum Liability: Our total liability shall not exceed the amount you paid for the App (if any) or $50, whichever is greater.

10. Professional Use Disclaimer

TrackedSnap is a tool to assist with project documentation. However:

It is NOT a substitute for professional surveying or measurement tools
GPS accuracy depends on device hardware and environmental conditions
Orientation data is approximate and should not be relied upon for critical measurements
Always verify important measurements with professional-grade equipment

11. Indemnification

You agree to indemnify and hold harmless Willis Worxs, LLC from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights (e.g., photographing private property without permission)
Your violation of applicable laws or regulations

12. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy. Please review it at Privacy Policy.

Key points:

Your data is stored on your device, and in your own iCloud Drive if you turn on iCloud Backup
We do not collect or transmit your personal information
You are responsible for backing up your data

13. Changes to Service

We reserve the right to:

Modify, suspend, or discontinue the App or any features at any time
Update the App to add features, fix bugs, or improve performance
Change subscription pricing with 30 days' notice to existing subscribers

We are not liable for any modifications, suspensions, or discontinuations.

14. Termination

You may stop using the App at any time by uninstalling it from your device. Upon termination:

Your license to use the App ends immediately
All locally stored data will be deleted when you uninstall the App
Active subscriptions will continue until the end of the paid period

15. Third-Party Services

The App may interact with third-party services:

Apple Maps: For displaying location data (subject to Apple's terms)
Apple StoreKit: For processing payments (subject to Apple's terms)
iOS Photo Library: For saving photos (subject to your device permissions)
Apple iCloud Drive: For iCloud Backup, if you turn it on (subject to Apple's terms)

We are not responsible for third-party service availability, accuracy, or policies.

16. Governing Law and Disputes

Governing Law: These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution: Any disputes shall be resolved through binding arbitration in California, rather than in court, except you may assert claims in small claims court if they qualify.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action or consolidated proceeding.

17. Updates to These Terms

We may update these Terms from time to time. Changes will be effective when we post the revised Terms with a new "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

For material changes, we may provide notice through:

In-app notifications
Email (if you've contacted us previously)
App Store update notes

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
